1. Acceptance of Terms

By registering for, logging into, or otherwise using Dagatal you confirm that you have read, understood, and agree to be bound by these Terms of Service as well as any referenced policies (including the Privacy Notice and Imprint). If you are acting on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts and Responsibilities

• Provide accurate registration information and keep it updated.
• Maintain the confidentiality of your login credentials and monitor account activity.
• Ensure all uploaded content (text, images, and embedded media) complies with applicable law and respects third-party rights.
• Accept full responsibility for every calendar you create, including the accuracy, legality, and audience impact of the content revealed behind each door.
• Understand that we may suspend or terminate accounts that violate these terms, abuse the service, or compromise security.

3. Acceptable Use

Dagatal is intended for creating interactive advent calendars. You agree not to:

• Interfere with or disrupt the service or servers.
• Upload malware, spam, or illegal content.
• Misrepresent your identity or impersonate another person or organization.
• Attempt to reverse engineer or access the source code of the platform.

4. Intellectual Property

We retain all rights, title, and interest in and to the Dagatal platform, including software, designs, trademarks, and logos. By uploading content you grant us a limited, non-exclusive license to host and display that content as needed to deliver the service. You remain the owner of your content.

5. Service Availability

We strive to keep Dagatal highly available but do not guarantee uninterrupted access. Maintenance windows or technical issues may temporarily affect the platform. We are not liable for data loss; please keep backups of important calendar content.

6. Premium Services & Billing

Dagatal offers optional premium features that enable advanced customization and functionality for your advent calendars. Access to premium features requires payment as described below.

6.1 Pricing & Payment

• Pricing: Current premium pricing is displayed on the platform before purchase. Prices are stated in Euro (EUR) and include applicable VAT where required.
• Payment Methods: We accept payments via Stripe (credit card, debit card, and other supported methods) or through redemption of premium access codes issued by us.
• Order Confirmation: Upon successful payment you will receive an email confirmation with order details and receipt.
• Invoicing: Payment receipts are automatically generated by Stripe and sent to your registered email address. For premium codes redeemed without payment, no invoice is issued.

6.2 Premium License & Features

Premium access grants you:

• Advanced calendar customization options (custom colors, visual effects, branding options).
• Removal of "Powered by Dagatal" branding from your public calendars.
• Priority support for technical issues.
• Access to new premium features as they are released during your active premium period.

Premium access is tied to individual calendars. Each calendar requires its own premium upgrade unless otherwise specified in promotional offers.

6.3 Subscription & Duration

Premium access is currently offered as a one-time purchase per calendar and remains active for the lifetime of that calendar. If we introduce subscription-based billing in the future, we will notify you in advance and provide clear terms for recurring charges, renewal, and cancellation.

6.4 Refund Policy

Due to the digital and immediately accessible nature of premium features, refunds are generally not available once premium access has been activated and you have begun using the features. However, if you experience technical issues that prevent you from using premium features, please contact support at support@dagatal.de and we will work to resolve the issue or consider a refund on a case-by-case basis.

6.5 Cancellation & Termination

• Your Right to Cancel: You may delete your calendar (which terminates premium access for that calendar) at any time through your account dashboard. No refund will be issued for unused premium time.
• Our Right to Terminate: We may suspend or terminate premium access if you violate these terms, engage in fraudulent activity, or abuse the service. In cases of payment disputes or chargebacks, premium access will be revoked until the matter is resolved.

7. Right of Withdrawal (Widerrufsrecht) for Digital Services

Under EU consumer protection law (particularly the Consumer Rights Directive 2011/83/EU), consumers purchasing digital content have a right to withdraw from the purchase within 14 days. However, this right is lost if you explicitly consent to immediate delivery and acknowledge that you lose your right of withdrawal once performance begins.

7.1 Consent to Immediate Access

When you purchase premium access, you explicitly request and consent to immediate activation of premium features. By completing your purchase you acknowledge and agree that:

• Premium features are made available to you immediately upon payment confirmation.
• By accessing or using any premium feature, performance of the digital service contract begins immediately.
• You expressly waive your right of withdrawal once you begin using premium features, in accordance with Article 16(m) of Directive 2011/83/EU.

7.2 No Withdrawal After Use

Because premium features are digital services delivered immediately and in full upon purchase, and because you have consented to immediate performance, the 14-day withdrawal period does not apply once you have accessed premium features. If you have not yet used any premium features, please contact support@dagatal.de within 14 days of purchase to request withdrawal.

7.3 Exception for Technical Defects

If premium features do not function as described due to technical defects or errors on our side, you retain the right to request a remedy (repair or replacement of functionality) or, if that is not possible, a price reduction or refund under applicable warranty laws. Contact support immediately if you encounter such issues.

8. Liability

The service is provided "as is" without warranties of any kind. To the extent permitted by law we disclaim responsibility for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability under these terms is limited to the amount you have paid for the service (if any) during the 12 months preceding the event giving rise to the claim.

For premium services, we warrant that the features will substantially conform to the descriptions provided at the time of purchase. If they do not, your remedy is limited to re-performance of the service or refund as described in the Refund Policy above.

9. Data Protection

Personal data is processed in accordance with our Privacy Notice. You agree not to upload special category data unless you have a lawful basis and ensure compliance with GDPR or other applicable regulations.

10. Changes to These Terms

We may update these terms to reflect legal, technical, or business changes. If updates are material we will notify registered users via email or in-app notice. Continued use after the effective date constitutes acceptance.
